Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the AmazeAlign website, online platform, smile assessment, products, services, communications, and related offerings (collectively, the "Services").

By accessing our website, submitting an assessment, creating an account, placing an order, purchasing a product, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.

1. About AmazeAlign

AmazeAlign provides online access to clear-aligner products and related dental products and services, including smile assessments, impression kits, custom treatment planning, remote monitoring, retainers, night guards, mouth guards, whitening products, and related customer support.

AmazeAlign may work with licensed dental professionals and other service providers in connection with treatment planning, clinical review, monitoring, and related services.

2. Eligibility

You must be at least 18 years old to purchase or use the Services unless the applicable service is expressly made available to a minor with the legally required authorization of a parent or legal guardian.

By using the Services, you represent that the information you provide is accurate, complete, and current.

We may refuse or limit access to the Services where we determine that a customer or case is not appropriate for a particular product or service.

3. Smile Assessment

AmazeAlign may provide an online smile assessment to collect information about your teeth and oral condition and to determine whether you may be a candidate for clear-aligner treatment.

The online assessment is not, by itself, a substitute for a comprehensive in-person dental examination.

Information provided through an assessment, including any preliminary indication of eligibility, is subject to further review and may change after additional information, photographs, impressions, scans, or clinical evaluation are received.

Completion of an assessment does not guarantee acceptance into treatment or guarantee that aligner treatment will be appropriate for you.

4. Dental and Clinical Care

Clear-aligner treatment is a dental treatment. Clinical decisions concerning diagnosis, treatment suitability, treatment planning, monitoring, and modifications should be made by appropriately licensed dental professionals where required by applicable law.

AmazeAlign may facilitate technology, products, communications, treatment-plan presentation, remote monitoring, and other administrative or support functions.

Where a licensed dentist or orthodontist is involved in your care, that professional is responsible for professional clinical decisions within the scope of their license.

You agree to provide complete and accurate information regarding your dental and medical history and to inform the applicable dental professional of relevant changes in your oral health.

5. Treatment Suitability

Not every customer is suitable for clear-aligner treatment.

Treatment suitability may depend on factors including:

• Dental and oral health;
• Tooth position and movement requirements;
• Gum and periodontal health;
• Existing dental work;
• Missing teeth;
• Cavities or other dental conditions;
• Jaw or bite conditions;
• Information provided during the assessment;
• Impressions, scans, photographs, or other records; and
• Clinical evaluation.

AmazeAlign or an applicable dental professional may determine that aligner treatment is not appropriate and may decline or discontinue treatment when reasonably necessary.

6. Treatment Plans

Where applicable, AmazeAlign may provide a digital treatment preview or 3D treatment plan before production.

You are responsible for reviewing the treatment plan and providing any requested approval before personalized aligners are manufactured.

Treatment plans may be adjusted when additional information becomes available or when clinically appropriate.

Estimated treatment durations are estimates only. Actual treatment time may vary depending on the individual's dental condition, biological response, compliance, treatment modifications, and other factors.

7. Customer Compliance

You agree to follow the instructions provided with your aligners and by your applicable dental professional.

Treatment results depend substantially on proper use and compliance.

You are responsible for wearing aligners for the recommended amount of time, following the prescribed sequence, completing required monitoring, following oral-hygiene instructions, reporting problems promptly, using products only as directed, and following professional dental recommendations.

Failure to follow treatment instructions may affect treatment results, treatment duration, fit, and eligibility for adjustments or refinements.

8. Treatment Results

Every person responds differently to orthodontic treatment.

AmazeAlign does not guarantee a specific cosmetic or clinical result, exact treatment duration, or exact tooth movement unless a specific written guarantee expressly applies to your order.

Any result, photograph, testimonial, treatment estimate, or before-and-after example displayed on the website is for illustrative purposes and does not guarantee that another customer will achieve the same result.

9. Products

AmazeAlign may offer personalized and non-personalized products, including clear aligners, night-time aligners, retainers, impression kits, dental or oral-care products, night guards, sports mouth guards, whitening products, and other products made available through the website.

Personalized products may be manufactured specifically for you and may therefore be subject to different cancellation, return, replacement, and refund conditions.

10. Impression Kits, Scans and Dental Records

Where an impression kit is provided, you are responsible for following the provided instructions and returning required materials within the applicable timeframe.

If impressions are unusable, incomplete, or otherwise unsuitable, AmazeAlign may require a replacement impression, scan, or additional information before proceeding.

Dental scans, appointments, or other professional services may have separate fees and cancellation conditions where applicable.

11. Remote Monitoring

Where remote monitoring is included in your plan, you agree to provide requested information, photographs, scans, videos, or other records within the required timeframe.

Remote monitoring does not eliminate the need for professional dental evaluation when such evaluation is clinically or legally necessary.

If you fail to complete required monitoring, AmazeAlign or the applicable dental professional may pause, modify, or discontinue treatment.

12. Orders and Payments

Prices displayed on the website are stated in U.S. dollars unless otherwise indicated.

You agree to provide accurate billing, payment, shipping, and contact information.

Payment may be processed through third-party payment processors. By submitting payment information, you authorize the applicable payment processor to process the transaction for the amount presented at checkout.

AmazeAlign may correct pricing, product, or typographical errors and may cancel an order affected by an obvious error.

An order is not necessarily accepted until AmazeAlign confirms the order.

13. Cancellations, Returns and Refunds

Our separate Return and Refund Policy forms part of these Terms.

The Return and Refund Policy governs cancellations, refunds, returns, impression kits, manufactured aligners, retainers, dental scans, refinements, night guards, mouth guards, oral-care products, shipping, and related matters.

Where there is a conflict between these Terms and a product-specific refund policy concerning a refund or return, the applicable product-specific policy will control.

You should review the Return and Refund Policy before placing an order.

14. Shipping and Delivery

Delivery dates and shipping estimates are estimates and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by manufacturing, customization, carrier delays, weather, incorrect address information, customs, or other circumstances outside AmazeAlign's reasonable control.

You are responsible for providing an accurate delivery address.

15. Personalized Products

Because certain AmazeAlign products are custom manufactured for individual customers, they may not be eligible for return after manufacturing has begun.

Once a personalized product has entered design, production, or manufacturing, cancellation or refund eligibility may be limited as described in the applicable Return and Refund Policy.

16. Refinements and Adjustments

Where adjustments or refinements are available under your treatment plan, eligibility, timing, and fees may depend on the specific treatment plan and circumstances.

Requests for refinements must be submitted within the applicable period specified by AmazeAlign.

Additional charges may apply where stated in the applicable treatment or refinement policy.

17. Retainers

Retainers are intended to help maintain the position of teeth following orthodontic treatment.

Teeth can move over time, including when retainers are not used as directed.

Replacement retainers may be subject to separate fees and eligibility requirements.

18. Night Guards and Mouth Guards

Night guards and sports mouth guards are designed for their intended purposes and must be used according to the instructions provided.

Changes to your teeth, dental work, oral condition, or bite may affect the fit of a personalized guard.

You should discontinue use and seek professional dental advice if a product causes significant pain, injury, or other concerning symptoms.

19. Whitening and Oral-Care Products

Whitening and other oral-care products must be used according to the manufacturer's instructions.

Results vary between individuals.

Some dental conditions, restorations, crowns, fillings, veneers, or other dental work may respond differently to whitening products.

If you experience significant irritation, pain, or another concerning reaction, discontinue use and consult an appropriate dental professional.

20. SMS and Text Messaging

AmazeAlign offers an optional SMS messaging program for customers who separately and affirmatively opt in to receive text messages from AmazeAlign.

Customers may opt in through the AmazeAlign Smile Assessment web form by providing their mobile phone number and selecting the separate, optional SMS consent checkbox. The SMS consent checkbox is not pre-selected.

By opting in, you agree to receive recurring SMS messages from AmazeAlign relating to your smile assessment, appointments, impression kits, orders, shipping and delivery updates, treatment-related communications, products and services, and customer support.

Consent to receive SMS messages is optional and is not a condition of purchasing any AmazeAlign product or service, submitting a smile assessment, or otherwise using the Services.

Message frequency varies.

Message and data rates may apply depending on your mobile carrier and plan.

You may opt out at any time by replying STOP to an AmazeAlign SMS message. After opting out, you may no longer receive SMS communications unless you separately opt in again.

Mobile information, including mobile phone numbers and SMS opt-in consent, will not be shared, sold, rented, or disclosed to third parties or affiliates for marketing or promotional purposes.

AmazeAlign may share mobile information with service providers that assist in delivering SMS communications solely as necessary to provide those services. Those service providers are not permitted to use mobile information or SMS consent for their own marketing or promotional purposes.

SMS consent is provided directly to AmazeAlign and is not transferable to third parties or affiliates for their own marketing or promotional communications.

Opting out of SMS does not prevent you from using other available methods to communicate with AmazeAlign.

21. Electronic Communications

By using the Services, you may receive non-SMS electronic communications from AmazeAlign concerning your account, orders, assessments, treatment, transactions, support requests, and other matters relating to your use of the Services.

General acceptance of these Terms does not constitute consent to receive SMS marketing or recurring SMS communications. SMS messages covered by the AmazeAlign SMS program are sent only to customers who separately opt in as described in Section 20.

You agree that electronic notices, disclosures, and communications other than optional SMS communications may satisfy applicable legal requirements for written communication where permitted by law.

22. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to notify AmazeAlign promptly if you believe your account has been accessed without authorization.

AmazeAlign may suspend or terminate accounts that violate these Terms or are reasonably believed to involve fraudulent, abusive, or unauthorized activity.

23. Prohibited Conduct

You may not:

• Use the Services for an unlawful purpose;
• Provide false or misleading information;
• Impersonate another person;
• Attempt to access another customer's account;
• Interfere with the Services;
• Introduce malicious software;
• Bypass security measures;
• Reproduce proprietary website content without authorization;
• Scrape website data without authorization; or
• Otherwise use the Services in violation of applicable law.

24. Intellectual Property

All AmazeAlign trademarks, logos, website content, software, designs, photographs, graphics, text, treatment-plan interfaces, and other materials provided through the Services are owned by AmazeAlign or its licensors unless otherwise indicated.

You receive a limited, non-exclusive, non-transferable right to use the Services for their intended purpose.

No intellectual-property rights are transferred to you by purchasing a product or using the Services.

25. User-Submitted Content

If you submit photographs, reviews, testimonials, feedback, or other content to AmazeAlign, you represent that you have the right to provide that content.

You retain ownership of your content, subject to the rights necessary for AmazeAlign to provide the Services.

AmazeAlign will use personal and health-related information in accordance with its Privacy Policy and applicable law.

AmazeAlign will not use identifiable customer photographs or testimonials for public marketing without the permissions required by applicable law.

26. Third-Party Services

The Services may rely on third-party providers for payment processing, shipping, communications, hosting, analytics, professional services, technology, or other functions.

Third-party services may be subject to separate terms and privacy policies.

AmazeAlign is not responsible for the independent acts, omissions, availability, or policies of third-party providers except to the extent required by applicable law.

For clarity, use of service providers to perform services on behalf of AmazeAlign does not authorize those providers to use customers' mobile numbers or SMS opt-in consent for their own marketing or promotional purposes.

27. Privacy

Your use of the Services is subject to the AmazeAlign Privacy Policy.

Because the Services may involve information concerning your dental or health condition, AmazeAlign may collect information that is sensitive or otherwise protected under applicable privacy laws.

The Privacy Policy describes the categories of information collected, purposes of processing, service providers and other disclosures, retention practices, security measures, and applicable privacy rights.

28. Medical and Dental Disclaimer

29. No Warranty

To the maximum extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis.

AmazeAlign does not warrant that the website or Services will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

30. Limitation of Liability

To the maximum extent permitted by applicable law, AmazeAlign and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

To the extent permitted by applicable law, AmazeAlign's aggregate liability arising from your use of the Services will not exceed the amount you paid to AmazeAlign for the specific product or service giving rise to the claim during the applicable period preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

31. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless AmazeAlign and its affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from your violation of these Terms, misuse of the Services, fraudulent or unlawful conduct, unauthorized use of another person's information, or violation of another person's rights.

32. Suspension and Termination

AmazeAlign may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent or abusive conduct, create security risks, or where suspension or termination is reasonably necessary to comply with law or protect AmazeAlign, its customers, or third parties.

Termination does not affect rights or obligations that accrued before termination.

33. Changes to the Services

AmazeAlign may modify, suspend, or discontinue portions of the Services from time to time.

We may update products, pricing, features, treatment processes, monitoring systems, or other aspects of the Services.

Changes will not retroactively alter rights that cannot legally be altered without appropriate notice or consent.

We may update these Terms from time to time.

The updated version will be posted on the website with a revised "Last Updated" date.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.

Changes to these Terms will not by themselves enroll you in the AmazeAlign SMS program. SMS enrollment requires the separate opt-in described in Section 20.

35. Governing Law

These Terms are governed by the laws applicable in the United States and, to the extent applicable, the laws of the State of South Carolina, without regard to conflict-of-law principles.

Nothing in these Terms is intended to deprive you of rights or protections that cannot lawfully be waived under applicable law.

36. Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact AmazeAlign and provide a reasonable opportunity to resolve the dispute informally.

Any dispute that cannot be resolved informally may be brought before a court of competent jurisdiction.

Nothing in this section limits rights that cannot legally be waived.

37. State Consumer Rights

Certain states provide consumers with rights that may not be waived by contract.

Nothing in these Terms is intended to limit any consumer protection, warranty, privacy, healthcare, or other right that applies to you under applicable federal or state law.

38. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be modified or removed only to the extent necessary, and the remaining provisions will continue in effect.

39. Entire Agreement

These Terms, together with the AmazeAlign Privacy Policy, Return and Refund Policy, applicable product-specific terms, and other policies expressly incorporated into these Terms, constitute the agreement governing your use of the Services.

For clarity, acceptance of these Terms does not constitute enrollment in the AmazeAlign SMS program. SMS consent is governed separately by Section 20.
